Britain passes up to date data bill, without AI -UPHOV LAWS

After intense debates, Britain’s parliament has finally passed ‘Data (use and access) Bill ‘ (DUA ACT), intended to simplify the use and access to personal data for UK data gulators while facilitating the administrative burden to use personal data.

The dua -act is based on Act on Data Protection 2018 and General Data Protection Regulation (GDPR)– Landmark European Union Regulation on Information on Privacy and Data – to modernize the UK’s computer system and facilitate more streamlined compliance processes without eroding the protection of the GDPR legislation.

On June 11, the bill went from the House of Lords to the Royal Assent Stage – the last stage of the legislative process in the UK, where the king essentially rubber bills that Parliament has approved.

When it receives its royal approval – at a date to be decided – the Dua law will become law and harden in the most significant change of Britain’s data protection frame Then GDPR.

Important updates in the bill include extending the range of data processing under ‘Legitimate interests‘As for direct marketing and security processing, reduction of interruptions and ineffective cookies, banners and regulations consent to increase market research, product development and technical innovation.

The structure and assignment of the UK’s information rights regulator, the information commissioner’s office (ICO), will also be “modernized”, which requires it to consider the general interest in promoting innovation and competition together Privacy and data protection.

Another change involves streamlining the process of submitting a “Data Ytter Access request” to make it more effective for individuals and organizations to request information about how a company uses or stores its information.

A key change that the bill includes is not a highly discussed change to force large technical companies and Artificial intelligence (AI) Companies to obtain permission and/or pay for British content, as the government insisted that it planned to deal with this topic in the future AI and copyright law-after The conclusion of a consultation About the subject in February.

The DPO Center, a leading UK Data Protection Manager and Resource Center, described Dua acts as “a targeted development of the current regime” rather than a complete deviation from existing framework.

The rocky road to royal consent

Dua Act’s Passage to Royal Assent was a long, uneven road that began under the former conservative government with Data Protection and Digital Access (DPDI) BillFirst was introduced in 2022.

DPDI established a number of provisions for how data can be reached, used and processed, including making it easier and clearer for organizations to use and reuse data for research purposes; clarify the processes and safeguard measures for the reuse of personal data; And facilitate compliance withdrawals on organizations related to record keeping, violation reporting and respond to unreasonable information requests from individuals.

However, DPDI failed to pass before the 2024 election, and in October 2024 the new Labor government introduced the revised Dua law.

The work proposal retained much of the original content while removing some of the more controversial provisions in DPDI, including one that would have enabled the government’s monitoring of ICO’s strategic priorities and another that required telecom providers to report suspected illegal marketing to ICO.

On May 12, the House of Lords voted – the upper chamber of the UK parliament – by a 147 majority to change the dua Act and add transparency requirements to ensure that British copyright holders must grant permission for their work.

The amendment would have forced technology companies to explain their use of copyright material when Exercise AI tools So that they could not access British content without paying for it – a proposal supported by prominent British recording artists like Elton John and Dua Lipa.

A few days later, however, the house – the lower (and elected) parliament’s chamber which is mainly responsible for producing legislation – rejected this change, with the government that reasoned that it already implemented one separately Consultation of AI and Copyright And wanted to wait for the result.

In an interview with BBC journalist Laura Kuensberg, Elton John described Common’s rejection of the amendment as “criminal” and added that if ministers continued with plans to let AI companies use the content of the artists without paying, they would “commit theft, twenty in high scale.”

Common’s decision also resulted in an extended back and forth, known as a “ping-pong”, between the two parliament houses, which were discussed, was changed, changed and rejected, with the legislation that bounced from one chamber to another in the process.

In the end, a compromise was struck, with Commons who rejected Lord’s amendment at AI, but the government agreed to publish reports of its AI and copyright Proposal within nine months of royal consent.

Ben Seretny, head of DPOs at the DPO center, says: “The final version of Dua Bill feels more like a thorough update than a radical review of UK GDPR and privacy and electronic communication rules (PECR).”

Seretny commented on June 12 on the passage of the bill from Parliament, because “while some areas are now clearer, others may introduce uncertainty.”

In particular, he noted that Dua ACT gives the Secretary of State more power to decide which countries have data protection standards that are not “significantly lower” than the UK – a change in language he proposed may affect the European CommissionThe which will review the UK’s Data ability Status in December.

In order for artificial intelligence (AI) to work properly within the law and thrive on growing challenges, it must integrate a corporate blockchain system that ensures data input quality and ownership – which makes it possible to keep data secure and at the same time guarantee data impossible.
